Oklahoma Highway Patrol Beats Bystander Walking Past Traffic Stop

Oklahoma Highway Patrol Troopers Daniel Martin and Tommy Allen assault a bystander trying to walk past a traffic stop Oct. 3 in Holdenville, OK.

After six weeks of paid leave, the troopers were excused for using excessive force by OHP’s Internal Affairs.

The attorney for Kristopher Douglas, the man beaten, called the OHP’s investigation a “dog-and-pony show” and “a sham,” and called Martin a menace.

Trooper Daniel Martin is best known for stopping an ambulance last July carrying a heart attack victim and choking a paramedic he felt did not show him respect. The YouTube video of that incident, captured on cell phone, was the second most watched YouTube video worldwide at the time.

The troopers in this round claimed that Douglas confronted the troopers during the traffic stop of a worker’s vehicle they claimed didnt yield sufficiently at a stop sign, which took place in his uncle’s driveway where they were remodeling his house. The Troopers stated they felt threatened by Douglas as he tried to walk around the arrest scene, and that they thought he was drunk and on drugs.

As Douglas walks along the fence past the arrest, Trooper Martin leaves the arrest scene to confront Douglas, at one point leaping directly into Douglas’ path.

Allen, the second Trooper, walks over and grabs Douglas’s wrist. Allen would later say he felt threatened by Douglas when Douglas looked at the hand grabbing his wrist and then back at the trooper assaulting him.

At this point, Martin whips out a retractable baton, striking Douglas near the groin in the process, while Allen grabs Douglas by the neck in an attempt to take the man to the ground. As Douglas is complying with orders to put his hands behind his back, Martin strikes him again with the baton on his backside.

Douglas was arrested and charged with obstructing an officer, a misdemeanor. Douglas’ uncle, Jerry Ford, witnessed the arrest and said the troopers overreacted and used excessive force.
Six weeks after the incident, where the OHP failed to interview any non-OHP witnesses and kept the dash cam video secret, the state police agency declared the troopers were justified in their use of force against Douglas and called the arrest “cut and dried.”

Lt. Tim Tipton, the OHP’s training officer on the use of force, led reporters through an elaborate explanation on how police use force, often contradicting what the video showed with his narration.
He said if Douglas had followed the officers’ first command to get away from the traffic stop “this would have been over very quickly.”
Tipton said Martin’s use of the baton was appropriate and within standards used by police to subdue combative suspects.

The video shows Douglas’ hands to his side throughout the incident, and no physical signs of combativeness.

Douglas’ attorney, Richard O’Carroll of Tulsa, asked “Why not just let the gentleman walk by?”.
He also asked why some of the witnesses to the arrest were never called to testify during the OHP’s board hearing.
O’Carroll also is the attorney for Maurice White, the paramedic involved in the May 24 scuffle with Martin at Paden. White has filed a federal lawsuit against Martin.

OHP Trooper Union’s attorney Gary James of Oklahoma City, said Tipton explained the arrest well.
James has also been the subject of conflict of interest and Department of Public Service corruption investigations.

Their jurisdiction to pursue a suspect trumps your private property claim. Try to interfere and see how fast you end up in jail.

    What a tool, the only time you’re going to “need” a cop is when one isn’t gonna help you. A cop isn’t going to be there when some jackass breaks into your house, or when you get jumped on some ill-traveled alleyway. In fact, 9 times out of 10, the only time you with a cop is when one is taking your money for violating some bullshit, cash-farming fluff-crime.

    This was private property, he had every right to be there. If anything, cop should have got the out of the driveway.
